1. About Us
ASG Dirtworx is a forestry mulching and land clearing business based in Covington, Georgia, serving the Atlanta metro and East Georgia area. These Terms apply to your use of our Site. They do not govern the performance of any land clearing, forestry mulching, or other services we may provide — those services are governed by a separate written estimate, proposal, or service agreement between you and ASG Dirtworx (see Section 4).
2. Eligibility and Acceptable Use
You must be at least 18 years old to use this Site. By using the Site, you represent that you meet this requirement. You agree not to: Use the Site for any unlawful purpose or in violation of these Terms; Submit false, misleading, or fraudulent information through any form on the Site; Attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks; Interfere with or disrupt the operation of the Site, including by introducing malware, bots, or automated scraping tools; Copy, reproduce, or republish content from the Site without our prior written permission.
3. Quote Requests and Communications
The Site lets you request a quote or contact us about our services. Submitting a form or otherwise contacting us does not create a contract or obligate ASG Dirtworx to provide any service. It simply starts a conversation. By submitting your contact information, you consent to be contacted by ASG Dirtworx by phone, text message, or email regarding your inquiry. Standard message and data rates may apply. You can opt out of future communications at any time by replying STOP to a text, unsubscribing from an email, or contacting us directly.
4. Services and Estimates Are Separate from These Terms
Any description of services, sample projects, or pricing information on the Site is provided for general informational purposes only. It is not an offer, a guarantee, or a binding quote. Actual pricing depends on site conditions, acreage, terrain, vegetation density, access, and other factors that can only be assessed for your specific property. All work performed by ASG Dirtworx is governed exclusively by a separate written estimate or service agreement that you and ASG Dirtworx agree to before work begins. In the event of any conflict between the Site and a signed estimate or service agreement, the signed agreement controls.
5. Intellectual Property
All content on the Site — including text, photographs, graphics, logos, the "ASG Dirtworx" name and brand, and the design of the Site — is owned by ASG Dirtworx or its licensors and is protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial purpose of learning about and engaging our services. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
6. User Submissions
Any information, photos of your property, project details, or other content you submit to us through the Site (collectively, "Submissions") may be used by us to respond to your inquiry, prepare an estimate, and provide our services. You represent that you own or have the right to share any Submissions and that they do not violate the rights of any third party. You grant ASG Dirtworx a non-exclusive, royalty-free license to use Submissions for the purpose of communicating with you and providing services.
7. Third-Party Links and Services
The Site may contain links to third-party websites or services (for example, scheduling, payment, mapping, or review platforms) that are not owned or controlled by ASG Dirtworx. We are not responsible for the content, policies, or practices of any third-party sites. Your use of those services is governed by their own terms and privacy policies.
8. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ASG Dirtworx does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that any information on the Site is accurate, complete, or current. Your use of the Site is at your own risk. This disclaimer applies only to the Site. Warranties relating to services we perform, if any, are set out in your separate service agreement.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ASG DIRTWORX AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless ASG Dirtworx and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site or your violation of these Terms.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Site, you consent to the practices described in the Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective Date" above. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site that is not subject to arbitration under Section 14 will be brought exclusively in the state or federal courts located in Newton County, Georgia, and you consent to the jurisdiction of those courts.
14. Dispute Resolution
We would rather solve any problem directly — please contact us first and give us a chance to make it right. If we can't resolve a dispute informally, you and ASG Dirtworx agree that any dispute arising out of or relating to the Site or these Terms will be resolved by binding arbitration administered by a recognized arbitration provider in Georgia on an individual basis. You and ASG Dirtworx waive any right to a jury trial and to participate in a class action. This section does not prevent either party from seeking relief in small claims court.
